In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 302, 201/34 of the I.P.C.
On the basis of the complaint petition this case has been lodged wherein after completing investigation the police submitted final form stating that the case was mistake of fact and then the informant filed a protest petition after lapse of more than five months of submission of the final form and on protest petition cognizance has been taken resulting the petitioners, who are Nanad and Nandoshi, are apprehending their arrest. Submission is that the petitioners are resident of
Patna High Court Cr.Misc. No.42248 of 2014 (2) dt.04-03-2015 2/2 another village. They have got no connection. They are aged about 62-60 years and both are having health problems. They have got no concern with the family affairs of the deceased and her husband as the petitioner no.1 after her marriage is living with her husband (petitioner no.2) in her sasural which is about 75 kilometer away from the place of occurrence.
In the facts and circumstances as stated above, considering that after completing investigation final form has been submitted and the petitioners are Nanad and Nandoshi and as such in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. Sri S.D. Bharti, J.M. Chapra in Dariapur P.S. Case No. 188 of 2011/ U.T. Case No. 239 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
