The petitioner seeks bail in a case registered for the offences punishable under sections 307 and other allied sections of the Indian Penal Code and section 3(i)(x) of the S.C./S.T. (Prevention of Atrocities) Act.

The petitioner and two others are alleged to have fired after entering into the house of the informant but only one injury that too lacerated 1⁄2 x 1⁄2 x 1⁄2 x muscle deep was found. The petitioner is in jail since 10.11.2014.

Mr. Ambika Bhagat, learned Special Public Prosecutor has submitted that it was the petitioner who has caused injury as the witnesses during the course of investigation have stated so.

Patna High Court Cr.Misc. No.38629 of 2015 (2) dt.28-08-2015 Considering the facts aforesaid and that the petitioner and others are alleged to have fired but only one injury is said to have been found and that too superficial in nature, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No. 452 of 2014, corresponding to Sessions Trial No. 59 of 2015.
