2. The petitioner seeks regular bail in the present case registered for the offence under Sections 302, 120B/34 of the Indian Penal Code.

3. In the F.I.R., six persons are named who have participated in the killing of the deceased. Mukesh Kushwaha and Rajpal Kushwaha are the assailant of the deceased. They have shot at the head of the deceased.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner has come during investigation on the confessional statement of the co-accused. Petitioner is in custody since 12.02.2024.

5. Learned A.P.P. has vehemently opposed the prayer

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj/concerned Court below in connection with Gopalganj P.S. Case No. 35 of 2024 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial.

(ii). Both the bailors should be close blood relatives of the petitioner.
