====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with a case registered for the offences under Section 379, other allied Sections of the Penal Code and Sections 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.

It is submitted on behalf of the petitioner that allegations set out in the fardbeyan is wholly false as there is no injury on the person of the informant or any other member of the prosecution party to corroborate the assault and in that light the assertion that petitioner called the informant by his caste name 'Chamar' is false as informant has implicated the petitioner and his family members in the present case for his failure to pay back the money which petitioner and his family members deposited in

Patna High Court Cr.Misc. No.41224 of 2014 (2) dt.10-04-2015 2/2 GTFS Multi Service Ltd. of which informant is also a member. Let petitioner, named above, surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and if there is no injury report on the record, he be admitted to the privilege of bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Biharsharif SC/ST P.S.
