JUSTICE RAVI RANJAN ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 302/34, 120B of the Indian Penal Code and Section 27 of the Arms Act.
It is contended on behalf of the petitioner that allegedly one Niraj Mishra, husband of the informant, was shot and was admitted in Referral Hospital where he subsequently died. The informant, while going to the hospital, saw the petitioner and the co-accused Nilesh Thakur coming from opposite side and said that everything has already been done. She alleged that they were wearing clothes having bloodstain. It is alleged that both the persons have conspired to kill her husband.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.42776 of 2016 (2) dt.06-10-2016 2/2 allegation is merely on the basis of suspicion as nobody has seen or stated that the petitioner has killed the husband of the informant. It is urged that the co-accused, on identical footing, namely, Nilesh Thakur @ Nilesh Kumar, has already been granted bail by a coordinate Bench of this Court vide order dated 18.03.2016 passed in Cr. Misc. No.3993 of 2016. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Pirpainti P.S. Case No.309 of 2015.
