JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 30.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the charges have been framed.
The informant alleges that this petitioner fired at his nephew Bittu causing injury on his leg which was found simple in nature, further it is alleged that the petitioner's side were trying to take forceful possession of the informant's land and had

No.67174 of 2021(2) dt.10-05-2022 2/2 marked about one kattha land by pillar for which the informant along with his uncle and nephew had gone to talk to the family of the petitioner when this occurrence took place. Learned counsel for the petitioner submits that similarly situated co-accused Manoj Singh has been granted bail vide order dated 13.04.2022 in Cr. Misc. No. 15563 of 2022. Learned A.P.P. for the State and the learned counsel for the informant vehemently oppose the prayer for bail of the petitioner but are not able to meet the submission of the learned counsel for the petitioner that the co-accused has been granted bail.
Considering the fact that the petitioner is in custody since 30.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case, the co-accused has been granted bail and the nature of injuries found on the injured is simple in nature, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Dhansoi P.S.
