This is an application for bail in connection with G.R.P. Mokama P.S. Case No. 42 of 2017 registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioners is of recovery of 84 litres of liquor from two trolley bags kept at Railway Station and petitioners are said to be carrying the said bags. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they have no criminal antecedents and they are in custody since 3.7.2017. Heard learned APP also.

Having heard both sides and in view of facts and circumstances, let petitioners, above named, be released on bail on

Patna High Court Cr.Misc. No.46565 of 2017 (2) dt.20-09-2017 2/2 furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna, in connection with G.R.P. Mokama P.S.Case No. 42 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioners will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, their bail bonds shall be cancelled.
