The petitioner is in custody since 20.07.2016 in connection with Banka (Panjwara) P.S. Case No. 395 of 2015, registered for offences punishable under Section 409 of the Indian Penal Code.

Allegation against the petitioner is that he misappropriated an amount of Rs. 6,18,487/- meant for construction of three class rooms of school. It has been submitted on behalf of the petitioner that admittedly, the part work for construction of three class rooms has already been done and for the remaining work, if released on bail, the petitioner is ready to complete the construction or shall pay the

Patna High Court Cr.Misc. No.49312 of 2016 (3) dt.15-12-2016 2/2 alleged amount of Rs. 6,18,487/-. The petitioner having no criminal antecedent and he has been languishing in judicial custody since 20.07.2016.

Having heard the parties and in view of the facts and circumstances, let the petitioner above named, be released on provisional bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 1st, Banka, in connection with Banka P.S. Case No. 395 of 2015, subject to the condition that the petitioner shall pay the aforesaid amount of Rs. 6,18,487/- within a period of four months from the date of release. Thereafter petitioner will surrender before the Court below along with receipt showing deposit of Rs. 6,18,487/- and after verifying the same to be true, the provisional bail granted by this Court may be confirmed by the learned Court below.
