The petitioner apprehends his arrest in a case registered for the offences punishable under Section 308 and other Sections of the Indian Penal Code.
Allegation against the petitioner and his father that they assaulted the wife of the informant and the petitioner snatched chain made of gold worth Rs. 31,000/-.
It is submitted that no specific allegation of assault is made against the petitioner. The injuries found on the person of wife of the informant are simple in nature. The father of the petitioner has already been enlarged on bail. It is further submitted that the informant and petitioners are own uncle and nephew. Considering the facts aforesaid and the fact that on

No.43317 of 2014 (5) dt.07-12-2015 2/2 account of some dispute with regard to well the occurrence took place and there is no specific allegation of assault against the petitioner, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in Islampur P.S. Case No. 36 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
