JUSTICE SHIVAJI PANDEY ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Bhagwanpur P.S. Case No. 100 of 2015 for offence under section 25(a-b)a/26/35 of the Arms Act. The petitioner had earlier moved before this Court for bail in Cr. Misc. No. 49345 of 2015 and this Court, vide order dated 05.11.2015, rejected the same with liberty to renew his prayer for bail after completion of six months of jail custody. The counsel for the petitioner submits that the petitioner is in custody since 24.07.2015.

Looking to the period of custody, let the petitioner, Binod Yadav @ Vinod Yadav, be released on bail on his

Patna High Court Cr.Misc. No.39348 of 2016 (2) dt.14-09-2016 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bhabua in connection with Bhagwanpur P.S. Case No. 100 of 2015, subject to the condition that (i) one of the bailors shall be mother/father/wife/son of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below.
