In this case, the petitioner is seeking anticipatory bail in connection with Ballia P.S. Case No.75 of 2018, registered for the offence punishable under Section 364/34 of the Indian Penal Code.

Allegation has been made that the accused persons including the present petitioners have kidnapped the husband of the informant and four that incident four persons have been shown as eye-witness.

Learned counsel for the petitioner submits that the informant is not an eye-witness to the incident and the petitioner has wrongly been implicated in this case.

Looking to the nature of allegation and also the fact that the petitioner has criminal history, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
