====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2018 Heard the learned counsels for the petitioner and the opposite party No. 2.

The petitioner seeks bail in anticipation of his arrest in connection with Gaya Civil Lines P.S. Case No. 124 of 2018, dated 04.04.2018, instituted for the offences under Section 135 of the Electricity Act, 2003.

The petitioner is alleged to have consumed electrical energy unauthorizedly even though he is a valid consumer of electrical energy.

The unauthorized consumption by the petitioner has been quantified at Rs. 97,744/-.

Patna High Court Cr.Misc. No.64048 of 2018(2) dt.13-12-2018 2/2 Subject to the deposit of Rs. 35,000/- in the office of the South Bihar Power Distribution Company Ltd., Vidyut Bhawan, Baily Road, Patna and furnishing proof of the same, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, shall be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Electricity Act, Gaya in connection with Gaya Civil Lines P.S. Case No. 124 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

It is made clear that the aforesaid deposit of Rs. 35,000/- shall be without prejudice to the case of the petitioner in future.
