The petitioners seek pre-arrest bail in connection with Bhabhua P.S. Case No. 256 of 2019 for the offences alleged under Sections 452, 380, 307, 504, 506 and 34 of the Indian Penal Code. The accusation is that in the late evening of 09.05.2019 the informant, Piyari Devi, after taking dinner slept in the house. In the meantime, she heard the sound of fall of utensils, she and her daughter woke up and saw petitioners along with 4-5 persons in their courtyard, who were armed with kutta (country made pistol) and gun and collecting the ornaments from the boxes. When the informant raised alarm, then, petitioner no. 1 laid her down in which she sustained injury in her right knee, left elbow and fore-head. He also pointed the pistol on her chest. Petitioner no. 2 also laid the daughter of the informant down and caused injury to her fore-head.
The learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.51720 of 2019(2) dt.20-08-2019 2/2 petitioners are pattedar and next door neighbours and have falsely been implicated in this case. The injuries on the persons of the informant and her daughter are simple in nature. Petitioners have no criminal antecedent.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bhabhua P.S. Case No. 256 of 2019 shall be released on pre-arrest bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhabhua at Kaimur, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
