The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 447, 448, 341, 323, 384, 379 and 504/34 of the Indian Penal Code. As per the prosecution case, the petitioner and other accused persons are said to have come with arms and iron rod etc. It is stated that the petitioner gave a blow with an iron rod on the head of the informant causing injuries. Other accused persons also assaulted and took away Rs. 22,000/- in cash. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations levelled in the FIR are falsified from the contents of the injury report (Annexure-2) wherein the injuries on the

Patna High Court CR. MISC. No.67578 of 2021(2) dt.27-04-2022 2/2 informant have been found to be simple in nature. The petitioner is in custody since 21.09.2021 and investigation in the case is complete.

Having heard learned counsel for the parities and taking into consideration the allegations in the FIR, the contents of the injury report of the informant together with the petitioner having remained in custody for 7 months, the petitioner, abovenamed, is directed to be enlarged on bail in connection with Bihar P.S. Case No. 240 of 2019 on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Bihar Sharif.
