2. The petitioner is apprehending his arrest in connection with Forest P.S. Case No. 104F of 2023 instituted for the offences under Sections 41 and 42 of the Indian Forest Act.

3. As per allegation, the complainant being the Forest Range Officer, was informed that, the petitioner and other accused persons used to sell wooden furniture having not the trees cut from side of the road and canal.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He submitted that nothing was recovered from his possession. He further submitted that the similar

Patna High Court CR. MISC. No.64890 of 2024(2) dt.16-12-2024 2/2 situated other co-accused has already been granted bail vide order dated 14.03.2024 passed in Cr. Misc. No. 17027 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran at Bettiah in connection with Forest P.S. Case No. 104F of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
