JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bettiah Town P.S. Case No. 335 of 2015, disclosing offences under Sections 376,511,447 and 448 of the Indian Penal Code and 8 of the Protection of Children From Sexual Offences Act, 2012. Allegedly, the petitioner entered into the informant's house and attempted to ravish her.
Learned counsel for the petitioner submits that the informant and the petitioner are next door neighbours and the case has been instituted out of certain lands dispute. He further submits that no purpose would be served if the petitioner is allowed to
Patna High Court Cr.Misc. No.37965 of 2015 (3) dt.08-10-2015 remain in jail any further as the police have already submitted charge sheet and the petitioner has been remained in custody for five months.
Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned First Additional Sessions Judge-Cum-Special Judge, POCSO Act, West Champaran, Bettiah in Bettiah Town P.S. Case No. 335 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
