The petitioner seeks bail in Bachhwara P.S. Case No. 164 of 2019, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016-18.

317.790 litres of foreign liquor and 11.7 litres of country made liquor, mobile phone and cash have been recovered from a Huindai Car. The apprehended co-accused persons disclosed the name of this petitioner. It is submitted that name of this petitioner has come in this case on the confession of apprehended co-accused persons. No recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and two cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise Act, Begusarai in connection with Bachhwara P.S. Case No. 164 of 2019, once the charge is framed in the case.
