JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-09-2018 This writ petition was filed by the petitioner against the order of cancellation of the appointment of the petitioner. Vide Annexure-2 dated 21.01.2007, it appears that service of the petitioner was terminated on the ground that training certificate obtained by the petitioner from Gandhi Hindi Vidyapith, Prayag, Allahabad is not a recognized degree. From the order-sheet, it appears that there is no interim order and the order of termination was passed 11 years back. We are in 2018. From the various orders passed, it appears that petitioner has lost interest in the present writ application. This case was listed in the last week but despite repeated calls,
Patna High Court CWJC No.10729 of 2007(5) dt.04-09-2018 2/2 no one appeared on behalf of the petitioner.
Under the aforesaid circumstances, this case has been listed under the heading "for dismissal" to provide one more opportunity to the petitioner to assist the court but unfortunately even today no one has appeared to assist the court. From the certificate appended to the writ application, it appears that petitioner has obtained baby teachers certificates. Such certificates are not recognized for the purpose of appointment as teacher in elementary school.
Under the aforesaid, the certificates are relevant for nursing teaching and not for the purpose of elementary teaching. In view of the above, the Court does not find any infirmity in the order of termination. Accordingly, the writ petition is dismissed.
