06-10-2016 Heard Sri Nawal Kishore Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 25-07-2016 in Chapra Muffasil P.S. Case No. 174 of 2016 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 47(a), 47(d) of Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that from an abandoned hut, huge quantity of country-made liquor was recovered and only on the basis of information given by some other that the petitioner is indulged in selling country-made liquor, the petitioner has been made accused.
Keeping in view the fact that petitioner is in custody
Patna High Court Cr.Misc. No.40918 of 2016 (3) dt.06-10-2016 2/2 since 25-07-2016 and nature of accusation, let the petitioner namely Naresh Chaudhary be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 174 of 2016.
