The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420/406/34 of the Indian Penal Code and Section 138 of the N.I. Act.
Submission is that for same cause of action earlier Civil Lines P.S. Case No.175 of 2017 was lodged. The petitioner was allowed bail by a coordinate Bench of this Court and thereafter the present FIR has been lodged. Allegation is that friendly loan was given by the informant to the husband of the petitioner for start of a partnership business. Allegation is that husband of the
Patna High Court Cr.Misc. No.59598 of 2018(2) dt.02-11-2018 2/2 petitioner and petitioner misappropriated the same. Considering the nature of allegation and remedy to the informant under Partnership Act as well as considering the fact that husband of the petitioner has already been allowed anticipatory bail in this case by this Court in Cr. Misc. No.60850 of 2018, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Civil Lines Police Station Case No.229 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
