The petitioner apprehends his arrest in connection with Mejarganj P.S. Case no. 88 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is that on receiving the secret information about carrying of illicit liquor loading on motorcycle by two persons, the informant along with other Police personnel reached at Jhanda Chowk and started the checking of vehicle. On seeing one motorcycle signal was given to stop, but the pillion rider succeeded to flee away, while one person was apprehended, who disclosed his name
Patna High Court CR. MISC. No.51439 of 2019(2) dt.19-08-2019 2/2 Jagga Paswan. On search of plastic bag, 59 bottles, each containing 300 ML Nepali soufi recovered. Jagga Paswan also disclosed the name of his associate as Ranjeet Paswan @ Thora Paswan.
Learned counsel for the petitioner submits that petitioner was not apprehended on the spot nor the seized motorcycle belongs to the petitioner. Further submission is that the name of the petitioner surfaced in the confessional statement of co-accused Jagga Paswan. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Addl. Sessions Judgecum-Special Judge, Excise Act, Sitamarhi in connection with Mejarganj P.S. Case No. 88 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
