2. The petitioner who is in custody since 30.07.2014 has renewed his prayer for bail in connection with Sasaram (T) P.S. Case No. 648 of 2014 for the offences alleged under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is submitted that since the petitioner's prayer for bail was earlier rejected on 04.03.2015, the co-accused Guddu Choudhary, said to be the main assailant has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 1174 of 2015. It is further submitted that similarly situated co-accused has also been granted bail by this Court in

Patna High Court Cr.Misc. No.40320 of 2015 (2) dt.09-12-2015 Cr. Misc. No.44078 of 2014.

5. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 648 of 2014 (G.R. No. 1376 of 2014) subject to the condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
