JUSTICE SHIVAJI PANDEY ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned counsel for the State as well as Complainant. The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 406 and 420 of the Indian Penal Code.

Allegation has been made that the petitioner has taken some government work in which complainant has also invested the money with the condition that whatever profits will be there that will be divided half and half between them. But petitioner has committed a fraud, though he has admitted the amount but the same has not been returned to the complainant.

No.59377 of 2018 (2) dt.08-10-2018 2 /2 Looking to the nature of the allegation made against the petitioner in the complaint this Court is of the view that this matter relates to claim of money between two parties. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Raghubar Singh, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-IIIrd-Cum-Additional Chief Judicial Magistrate, Patna in connection with Complaint Case No.2816(C) of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
