The petitioner seeks bail in Halsi P.S. Case No. 80 of 2014 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act corresponding to Sessions Trial No.180 of 2015.
The learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 23.4.2015 passed by this Court in Cr. Misc. No. 7872 of 2015 with a direction to the trial court to conclude the trial within one year, but the trial has not yet been concluded. It appears that the petitioner fired at the chest of Kameshwar Prasad killing him on the spot.
Learned counsel for the Informant submits that the
Patna High Court Cr.Misc. No.40599 of 2016 (2) dt.14-12-2016 2/2 witnesses have already been examined and only Doctor is left to be examined for which the next date for evidence is fixed on 19.12.2016.
Considering the aforesaid, I am not inclined to enlarge the petitioner on bail.
Accordingly, the prayer for bail of the petitioner stands rejected.
