Petitioner is apprehending his arrest in connection with Rupaspur P.S.Case No.244 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act..
As per information, the police got information that some liquor is being carried by Maruti car and it is also alleged that one person got down from that car and the car proceeded. One person was apprehended and 01 ltrs. of liquor has been recovered.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession nor he has been arrested rather only on suspicion he has been made
Patna High Court CR. MISC. No.52955 of 2019(4) dt.07-11-2019 2/2 accused and no incriminating materials has come against the petitioner. He is not owner of the Maruti car. He has no criminal antecedent with regard to such type of cases. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise Act, Patna in connection with Rupaspur PS Case No.244 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
