Learned counsel for the informant submits that trial is likely to be completed as all the prosecution witnesses have been examined except the Doctor.
Learned Senior Counsel for the petitioner submits that since the Doctor is only left to be examined, as such, a time limit be fixed for concluding the trial and at the same time seeks permission to withdraw the bail application.
Permission is accorded.
Accordingly, the present bail application is dismissed as withdrawn in connection with Habibpur P.S. Case No. 94 of 2021 pending in the Court of learned Additional Chief Judicial
Patna High Court CR. MISC. No.66577 of 2021(2) dt.27-04-2022 2/2 Magistrate-IX, Bhagalpur/successor Court.
The learned court below is directed to conclude the trial within a period of three months from the date of receipt/production of a copy of this order.
The District Magistrate, Bhagalpur is also directed to ensure the presence of the Doctor in the trial as and when reuired by the learned court below, failing which it would be presumed that the authorities are not interested in getting the trial concluded.
