JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Rudal Singh, learned counsel for the petitioner and learned Additional Public Prosecutor The sole petitioner, who is in custody since 18.2.2016 in Nawada Town P.S. Case No. 799 of 2015 registered for the offence under Section 461/ 379 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that initially on false accusation petitioner was arrested in a case i.e. Nawada Town P.S. Case No. 05 of 2016 registered for the offence under Section 399, 402, 414 of the Indian Penal Code and Section 25 (1-B) 26, 35 of the Arms Act and thereafter he was remanded in other cases including the present case. He submits that though petitioner was remanded in this case, petitioner has never been put on T.I. parade.

Patna High Court Cr.Misc. No.40631 of 2016 (2) dt.04-10-2016 2/2 Keeping in view the nature of accusation and period of custody, let the petitioner Rustam Dom be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada / concerned court in connection with Nawada Town P.S. Case No. 799 of 2015.
