The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420 of the Indian Penal Coder.
As per prosecution case, the informant who is Area Manger of Fino Finance, alleged that in November 2018 from his Branch loan was passed in the name of 11 persons as mentioned in FIR by the accused persons who were posted as Branch Manager and CRO in his Company. They duped Rs. 1,95,088/- to such customers and thus cheated and committed criminal breach of trust.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.56562 of 2022(3) dt.16-02-2023 2/3 petitioner is innocent and has committed no offence. The said incident took place due to negligence on the part of the informant and before the present FIR, petitioner has already resigned from the said company on 12.4.2019, which clearly shows that the petitioner has falsely been made accused in this case due to ulterior motive and this fact is aslo mentioned in para 7 of the petition. It is further submitted that the account holders did not make any complaint in respect of this incident. He has got no criminal antecedent. Moreover, similarly situated co-accused namely, Sashi Bhusan Kumar has already been granted anticipatory bail by a coordinate bench of this court vide order dated 30.6.2022 in Cr. Misc. No. 40621 of 2021. It is further submitted that the petitioner is languishing in judicial custody since 31.7.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kahalgaon P.S. Case No. 519 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
Patna High Court CR. MISC. No.56562 of 2022(3) dt.16-02-2023 3/3 amount each to the satisfaction of learned CJM, Bhagalpur/ concerned court.
