JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 02.07.2015 in connection with Jehanabad Mahila P.S. Case No. 57 of 2014 for the offences instituted under Sections 376, 504 and 506/34 of IPC. The prosecution story, in brief, is that the prosecutrix is a lady of questionable character and she has got illicit relation with some one and having seen the family status of the petitioner, this absolutely false case against the petitioner. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 02.07.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence
Patna High Court Cr.Misc. No.39669 of 2015 (3) dt.24-11-2015 2/2 against the petitioner. As per prosecution case, on the ground of false assurance regarding marriage, the petitioner is said to have established physical relationship with the informant. The petitioner is a student and pursuing his study. It is further submitted that for oblique reason, the present prosecution has brought against him. From perusal of paragraph no. 57 of the case diary, it is evident that the petitioner has falsely been implicated in the present case as stated by the witnesses in course of investigation.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Jehanabad Mahila P.S.
