JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she stated that she was taken to Hulasganj market by one Karu Yadav and others and after that they sold her to one person, who made her captive in his house and after that she was rescued by the police but Para-14 of the case diary goes to show that petitioner was arrested from his house and the investigating officer has not mentioned in the aforesaid

Patna High Court Cr.Misc. No.28554 of 2016 (3) dt.30-09-2016 2/2 paragraph about the recovery of victim from the house of the petitioner. Moreover, the victim has not made any complain of ill treatment towards her by the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Singh, Judicial Magistrate 1st Class, Hilsa, Nalanda in connection with Khudaganj P.S.
