====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-09-2018 Heard Sri Dhirendra Kumar Sinha, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.

The sole petitioner, who is P.D.S. dealer, apprehending his arrest in Wazirganj P.S. Case No. 311 of 2017 registered for offence under Sections 467, 468, 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act, has prayed for grant of bail, in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. He further submits that only on presumption and assumption, the petitioner has been made accused. Besides hearing, I have perused the material on

In view of facts and circumstances, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Narayan Prasad be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Gaya in connection with Wazirganj P.S. Case No. 311 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
