====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Phulwaria P.S. Case No. 116 of 2017 registered for the offence punishable under sections 147, 148, 149, 153A, 353A, 295A, 332, 327, 337, 307 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Entire allegation is general and omnibus in nature. Nothing specific allegation of abuse, assault has been levelled against this petitioner. Moreover, similarly situated coaccused persons have been granted bail by different Co-ordinate Bench of this Court vide order dated 23.01.2018, 01.02.2018, 16.02.2018, 17.02.2018, 17.02.2018, 17.02.2018 and

Patna High Court Cr.Misc. No.59758 of 2018(2) dt.31-10-2018 2/2 29.03.2018 passed in Criminal Misc. No. 3077 of 2018, 3951 of 2018, 7965 of 2018, 9463 of 2018, 8990 of 2018, 9321 of 2018 and 16897 of 2018 respectively.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Begusarai in connection with Phulwaria P.S. Case No. 116 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
