The petitioners seeks bail in Barahara (Raghuwans Nagar) P.S. Case No.125/2015 registered under Section 395 of the Indian Penal Code.
It is alleged that on 24.5.2015 the informant went to market for purchasing leather along with driver of pick up Van. When they reached near Bhuvaneshwar Asthan then seven miscreants overtook them and on the point of pistol looted an amount of Rs.28,000/- along with mobile phone. It is submitted on behalf of the petitioners that the petitioners are in custody since 29.5.2015. The charge sheet has
Patna High Court Cr.Misc. No.41269 of 2015 (3) dt.30-10-2015 been submitted in this case. There is no allegation of tampering with the evidence against the petitioners. The petitioners are not named in the first information report and they have not been put on T.I. Parade to ascertain their involvement in the alleged occurrence. The other co-accused has been released on bail vide order dated 6.10.2015 passed in Cr. Misc. No.46768/2015. On behalf of the State, it has been submitted that the names of the petitioners have come in the course of investigation. Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Barahara (Raghuwans Nagar) P.S. Case No.125 of 2015.
