JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 The petitioner being husband of the victim has renewed prayer for bail in connection in a case registered for the offences punishable under section 304B/34 of the Indian Penal Code.

The petitioner is in custody since 12.12.2012 with accusation of killing the daughter of the informant within ten months for non-fulfillment of dowry demand.

The report of the Superintendent of Police, Madhepura dated 13.05.2015 reflects that only I.O of the case, S.I. K. K. Choudhary is left to be examined. Though son of the informant has again been summoned by the learned trial court on the prayer of the defence for further cross-examination. Considering the present stage of the trial, this court is not inclined to interfere with the present application. Accordingly,

Patna High Court Cr.Misc. No.42262 of 2014 (4) dt.24-06-2015 2/2 it is disposed of.

It is expected from the trial court to conclude the trial in Sessions Trial No.144 of 2013, preferably within a period of five months. It is expected from the Superintendent of Police, Madhepura to produce the left over witnesses i.e. I.O. of the case before the learned trial court on the next date fixed. However, the petitioner would be at liberty to renew his prayer for bail, if the trial is not concluded within the time frame.
