The petitioner seeks bail in connection with Sahebganj P. S. Case No. 181 of 2019 registered under Sections 147, 149, 353 and 307 of the Indian Penal Code, Section 25(1B)(a), 26, 27 and 35 of the Arms Act and 13, 15, 16, 17, 18 and 20 of the UAP Act.
Learned counsel for the petitioner submitted that co-accused Shyam Bahadoor Kumar and Kundan Kumar having more or less identical allegation to that of the petitioner, have already been granted bail by different Benches of this Court vide orders dated 29.07.2019 and 30.07.2019 passed in Cr. Misc. No. 46710 of 2019 and 46620 of 2019 respectively. Learned counsel for the State does not dispute the
Patna High Court CR. MISC. No.55377 of 2019(3) dt.27-11-2019 2/2 aforesaid contention advanced on behalf of the petitioner. Having regard to the fact that similarly circumstanced co-accused have already been granted bail by different Benches of this Court, the petitioner, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Sahebganj P. S. Case No. 181 of 2019.
