JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 419,420,468,471 and 120B/34 of the Indian Penal Code.

Petitioner no.2 is wife of petitioner no.1. Petitioner no.1 at the relevant point of time was posted as Circle Officer, Rajgir in the year 2010 during which he is said to have committed offence in his capacity as Circle Officer.

Learned senior counsel appearing on behalf of the petitioners has submitted that similarly situated persons has been granted bail by this Court and he further submits that the

Patna High Court Cr.Misc. No.42154 of 2014 (2) dt.16-04-2015 petitioner no.1 has undergone kidney transplant surgery and petitioner no.2 being the lady, they deserve the privilege of anticipatory bail.

In view of the submissions as above, let petitioners above named in the event of their arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir P.S. Case No. 194 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
