(APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 23-07-2015 The petitioner figured as accused in Kazi Mohammadpur P.S. Case No.47 of 2012 registered for the offences punishable under Sections 420, 406, 467, 468 and 471 of the Indian Penal Code.
Apprehending his arrest, the petitioner filed ABP No.1622 of 2014 before the Sessions Judge, Muzaffarpur. The same was rejected on 12.09.2014 . Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C. Learned counsel for the petitioner submits that the dispute is mostly in relation to land and the allegation against the petitioner is false.
On perusal of the record, this Court finds that arrest of the petitioner is not essential for further progress in the
Patna High Court Cr.Misc. No.42448 of 2014 (3) dt.23-07-2015 2/2 matter. The petitioner can be required to cooperate with the police as and when required.
Therefore, the application is allowed. In the event of arrest, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No.47 of 2012, on condition that the petitioner shall appear before the concerned police station, as and when required in connection with the investigation.
