The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 412 and 34 of the Indian Penal Code and under Section 25(1-B)A 26/35 of the Arms Act. The petitioner and other accused persons were apprehended on the information that they were fleeing away after committing dacoity. From possession of the petitioner ornaments were recovered and from possession of Arvind Kumar also ornaments and mobile were recovered. Arvind Kumar has already been enlarged on bail vide orders passed in Cr. Misc. No. 26752 of 2015. The petitioner is in jail since 20.03.2015 and the case of the petitioner stands on same footing.

Considering the facts aforesaid, the petitioner above

No.41020 of 2015 (2) dt.09-09-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Maheshkhut P.S.
