The petitioner seeks bail in Chapra Town P.S. case No. 258 of 2016 under Section 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.

The informant filed a complaint petition on the basis of which the present FIR was lodged. The informant alleged that petitioner, after taking the informant in confidence, took money from him on condition that he will pay 5% in the share of profit and 3% per month of the principal amount. The accused persons started paying the same since December, 2011 till 24.12.2015. It is alleged that Rs. 25, 22, 693/- remained lying due against the petitioner.

Patna High Court Cr.Misc. No.50346 of 2016 (4) dt.11-07-2017 2/2 Sri Rama Kant Sharma, the learned counsel senior counsel for the petitioner, submits that the dispute is with regard to rendition of accounts. The matter was earlier heard and sent to Mediation Centre but the dispute could not be resolved. According to the petitioner, he had already paid almost the entire amount to the informant whereas the learned counsel for the informant disputed this fact and submitted that still huge amount is lying due against the petitioner. It is submitted on behalf of the informant that petitioner is in habit of taking money from different persons. Taking into consideration the facts that the dispute arose on account of rendition of accounts and for that the petitioner has remained in jail for two and half months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Chapra Town P.S. Case No. 258 of 2016.
