The petitioner seeks regular bail in connection with Chhatapur P.S. Case No. 236 of 2017, for the offences punishable under sections 147, 148, 149, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.
The case of the prosecution is that the petitioner was trying to make film of the female inmates of the informant while they were taking bath and upon protest, the petitioner indulged in assault and abusing the informant side.
The learned counsel for the petitioner submits that the present case is a case and counter case and in fact the mother of the petitioner had lodged a complaint leading to registration of
Patna High Court Cr.Misc. No.37755 of 2017 (2) dt.10-08-2017 Chhatapur P.S. Case No. 235 of 2017 dated 29.6.2017 wherein the informant of the present case is accused no. 1. It is further submitted that the present case i.e. Chhatapur P.S. Case No. 236 of 2017 has been lodged thereafter. The further case of the petitioner is that petitioner has a clean antecedent and as far as injury is concerned the opinion is reserved.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner Aklesh Ram on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Supaul in connection with Chhatapur P.S.
