Petitioner happens to be husband of the deceased and it came in course of investigation that this petitioner had developed illicit relation with the deceased and when deceased became pregnant, petitioner was forced to solemnize marriage with the deceased and thereafter, petitioner's marriage was solemnized with the deceased. Although informant and some witnesses claimed that it was the petitioner and his wife, namely, Ashgari Begum who committed murder of the deceased but none has seen the actual killing of the deceased.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Bahadurganj P.S. Case no. 97/2011. shahid (Hemant Kumar Srivastava,J) U T
