JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

On 17.03.2016 foreign liquor was alleged recovered from a Magic Van said to be of the petitioner. Submission of the petitioner is that possession of foreign liquor was not an offence on the alleged date of recovery and some other co-accused have already been allowed bail by a coordinate Bench of this Court on 20.05.2016 in Cr. Misc. No.20858 of 2016.

Patna High Court Cr.Misc. No.49117 of 2016 (2) dt.21-12-2016 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Forbesganj P.S. Case No.126 of 2016.
