The petitioner apprehends his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, while the informant was going to deliver the articles of some courier company towards village- Dhanupara, on the way, four miscreants riding on two motorcycles came and on the point of pistol snatched away, cash, mobile, articles and other valuable documents from his possession.
It is submitted that petitioner is not named in the FIR. Petitioner has been made accused in this case on the basis of confessional statement of co-accused person who was
Patna High Court CR. MISC. No.55927 of 2022(2) dt.22-12-2022 2/2 apprehended with incriminating articles. Nothing has been recovered from conscious possession of this petitioner. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IVth, Muzaffarpur (West) in connection with Saraiya (Jaitpur OP) P.S.
