2. Petitioner seeks regular bail in connection with Mairwa P.S. Case No.185 of 2025 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is total recovery of 1893.450 litres illicit liquor, out of which 1461 litres liquor was recovered from truck and 432.450 litres liquor was recovered from tempo. The petitioner is alleged to have tried to flee away from the spot but on chase, he was apprehended.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on the basis of suspicion being the driver of the seized truck. No incriminating material has been recovered from

Patna High Court CR. MISC. No.56993 of 2025(2) dt.21-08-2025 2/2 conscious possession of the petitioner. The petitioner has no concern with the seized liquor or with truck in question. It is further submitted that similarly situated co-accused Rajesh Kumar has already been granted regular bail by a Coordinate Bench of this Court vide order dated 13.08.2025 passed in Cr.Misc.No.54681 of 2025. Petitioner has no criminal antecedent. Petitioner is in jail since 29.04.2025 and he undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.3, Saran in connection with Mairwa P.S. Case No.185 of 2025.
