JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2022 At the outset, counsel for petitioner seeks permission to withdraw the anticipatory bail application of Dhurkheli Das @ Dhurendra Das petitioner no. 1, as during pendency of this case petitioner no. 1 has already been arrested. Permission be accorded. The anticipatory bail application with regard to Dhurkheli Das @ Dhurendra Das is dismissed as withdrawn.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Banka P.S. Case No. 137 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal

Patna High Court CR. MISC. No.66295 of 2021(2) dt.14-07-2022 2/3 Code and section 3/4 of the Explosive Substance Act. Allegation against this petitioner is that he along with co-accused persons were collecting extortion money from truck driver. It is further alleged that during that course, a protest was made by a truck driver upon which co-accused and these petitioners exploded bomb with a view to create panic and some of the drivers also sustained injuries.

It is submitted that earlier petitioner has filed a case bearing SC/ST Case No. 08 of 2021 (Annexure-2) against the informant for making demand of money in the name of Chanda and also abuse him by calling his caste name. Present case is counter blast of SC/ST Case No. 08 of 2021. Petitioner has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 137 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of
