20-03-2015 After some argument, Md. Najmul Hoda, learned counsel for petitioners, in presence of Sri Nagendra Prasad, learned Addl. Public Prosecutor, in view of observation given by learned Sessions Judge, Bhagalpur on 26-08-2014 in A.B.P. No. 1719 of 2014, makes a prayer for withdrawal of the present petition so that petitioners may appear before the court below and make a prayer for regular bail.

The prayer is allowed with an observation that if petitioners surrender before the court below within a period of eight weeks from today and file bail application, the learned court below, without being prejudiced with this order, may examine the case on its own merit and pass appropriate order in accordance with law preferably on the same date.
