JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-10-2017 Heard the counsel for the petitioners and the informant. Petitioner no.1 is alleged to have caused the death of his father. Petitioner no.2 being the son of petitioner no.1 assisted him. They are facing prosecution under sections 302/120-B IPC. On account of previous litigation and dispute with respect to the property, the allegation is said to have been levelled. Learned counsel for the petitioners submits that there is no eye-witness to the occurrence. Merely on suspicion, they have been made accused(s). They are in custody since 31.03.2017. Counsel for the informant, on the other hand, submits that earlier also the petitioners had attempted to cause the death for which a criminal case is pending.
Patna High Court Cr.Misc. No.47555 of 2017(2) dt.16-10-2017 2/2 Considering the nature of allegation and other materials reflecting from the records, the Court is not inclined to direct release of the petitioners. Prayer for bail is rejected. However they shall be at liberty to renew their prayer for bail after 08 months if the trial is not taken up and records adequate progress.
