JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 307 and other minor Sections of the Indian Penal Code. Petitioner and other accused are said to have assaulted the informant by three knot on his head. The informant sustained altogether six injuries out of them opinion regarding nature of Injury Nos.1 and 6 was kept reserved whereas rest injuries were found simple in nature. The Injury No.1 was found at right forearm whereas Injury No.6 was found on left hand and, therefore, both the injuries were not found on the vital part of the body. Petitioner is in jail custody since 26.4.2016 and it appears that the alleged occurrence took place due to political rivalry and

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria in connection with Alouli P.S. Case No.97 of 2016.
