JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioner seeks regular bail in connection with Beldaur P.S. Case No. 90 of 2017 registered for offences punishable under Sections 290, 273 and 34 of Indian Penal Code and 30(a), 37(a) of the Bihar Provision and Excise Act, 2016. Allegation is of recovery of 7 liters of country made liquor from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner and he has been rotting in judicial custody for the last three months.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and circumstances of the case and in view of the fact that the petitioner
Patna High Court Cr.Misc. No.35683 of 2017 (2) dt.08-08-2017 has also got antecedent of similar type of cases, I am not inclined to release the petitioner on bail, at this stage, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it preferably within a period of three months if the trial is not concluded within the stipulated time, the petitioner is at liberty to renew his prayer for bail. (Vinod Kumar Sinha, J) brajesh/- U t
