ANJANA PRAKASH ORAL ORDER 08-07-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Mashrakh P.S. case No.155 of 2011 (S.T. No.46 of 2012) instituted for the offence under Sections 452, 323, 324, 307, 380 and 302/34 of the Indian Penal Code, pending in the court of Additional Sessions Judge 1st, Chapra.
Perused the report of the Jail Doctor with regard to mental condition of the Petitioner. However, he has not reported as to whether the Petitioner is in a state of mind to understand the proceedings of the Court and enter into his defence. If the matter is kept pending here, it will necessarily delay the trial. Hence, it is disposed off with a direction to the Trial Judge to call for a report from the doctor concerned in terms
Patna High Court Cr.Misc. No.42577 of 2014 (6) dt.08-07-2015 2/2 of Sections 328, 329, 330, 334, 335 Cr.P.C. immediately and proceed in accordance with law, so interest of justice does not suffer.
